Terms and Conditions

These Terms and Conditions govern access to and use of the Peptiqo Labs website, research-access program, accounts, catalog, and related services. Peptiqo Labs is operated by VIAL TEKNOLOGIES LLC. In these Terms, "Peptiqo Labs," "we," "us," and "our" refer to VIAL TEKNOLOGIES LLC.
By using the website, requesting access, creating an account, or placing an order, you agree to these Terms and our Privacy Policy, Shipping Policy, Returns and Refunds Policy, and Research Use Only and Business Eligibility Policy. If you act for an organization, you represent that you have authority to bind that organization.
1. Eligibility and age
The store serves eligible purchasers in the United States. A purchasing representative must be at least 21 years old and authorized to place the order.
By creating an account or placing an order, you represent that:
- the information you provide is accurate, current, and complete;
- you are at least 21 years old;
- you are authorized to place the order;
- the purchase is for a legitimate laboratory research purpose; and
- you will use products only as permitted by these Terms and applicable law.
We may decline, hold, or cancel an order or suspend an account if eligibility or authority cannot be verified, information appears inaccurate, or activity appears inconsistent with these Terms, subject to applicable law.
2. Research use only
Products offered by Peptiqo Labs are sold for research use only. They are not for human use, not for veterinary use, and not for clinical, diagnostic, therapeutic, food, dietary supplement, cosmetic, or household use.
You are responsible for determining whether your organization may lawfully acquire, possess, store, handle, document, use, and dispose of each product. Products must be handled only by appropriately trained and authorized personnel under applicable laws, institutional rules, workplace procedures, product information, and safety requirements.
Product information is provided for research catalog and purchasing purposes. It is not medical, veterinary, diagnostic, treatment, safety, or regulatory advice. You may not resell, transfer, relabel, divert, or use a product for a prohibited or unlawful purpose.
3. Accounts, checkout attestation, and review
A signed-in account and the current research-use attestation are required to place an order. Creating an account, completing the attestation, or receiving an automated order acknowledgement does not mean that an order has been accepted.
We may request information about the purchaser, organization, authority to order, or research context before accepting or fulfilling an order. You are responsible for protecting account credentials and for activity conducted through your account. Accounts may not be transferred or shared with an unauthorized person. Contact us promptly if you suspect unauthorized access or if submitted information is no longer accurate.
4. Catalog information and testing records
We aim to present product descriptions, images, quantities, availability, and prices clearly. Catalog content may contain errors or change without notice. Images may be illustrative. The product label and lot information supplied with an order control where they differ from a general catalog image.
Testing records are displayed only when a record has been posted for the specific product or lot. If no record is posted, do not assume that a test was performed, that a record exists, or that a record for another lot applies. Verify product and lot identifiers before relying on a posted record.
Unless expressly stated in a posted record, we do not represent that testing was independent, comprehensive, performed to a particular standard, or suitable for your intended research. Contact us before ordering if a specific record is material to your purchasing decision.
5. Orders and availability
Placing an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. We may reject or cancel an order because of eligibility review, payment failure, inventory error, shipping restriction, suspected fraud, pricing error, or apparent prohibited use. If a canceled order was charged, any required refund will be initiated to the original payment method.
Availability is not guaranteed. We may set quantity limits or request additional verification.
6. Prices, taxes, and payment
Prices are listed in U.S. dollars unless stated otherwise. Shipping and any other charges collected with the order are displayed during checkout. Any tax that Peptiqo Labs is required to collect will be handled according to applicable law; no statement on the website changes either party's tax obligations.
Payments are processed by PayPal and its payment services under PayPal's terms and privacy practices. We may use fraud-prevention and verification measures before accepting or fulfilling an order.
7. Shipping
We ship only to eligible U.S. addresses accepted at checkout. Standard flat-rate shipping is $9.99 per order. Processing and delivery timing can vary and will be communicated through order and shipping updates when available. Carrier estimates are not guarantees unless a guaranteed service is expressly identified at checkout.
The Shipping Policy is incorporated into these Terms.
8. Returns, damage, and order errors
An eligible product may be returned within 14 calendar days after delivery only if it is unopened, unused, in its original sealed packaging, and otherwise meets the Returns and Refunds Policy. Damage or an incorrect item should be reported within 48 hours after delivery so we can investigate and preserve shipping evidence.
For an approved voluntary return, the customer pays return shipping. Peptiqo Labs covers the approved resolution of a verified damaged shipment or wrong item. Exchanges are not available unless Peptiqo Labs approves one in writing. The Returns and Refunds Policy is incorporated into these Terms.
Nothing in these Terms limits a right or remedy that cannot lawfully be waived or limited.
9. Prohibited conduct
You may not:
- use the website or products for an unlawful, human, veterinary, clinical, diagnostic, therapeutic, personal, or other prohibited purpose;
- provide false access, identity, age, organization, payment, shipping, or intended-use information;
- permit an unauthorized or underage person to use a purchasing account;
- interfere with website security, scrape restricted content, introduce malicious code, or attempt unauthorized access;
- infringe intellectual property or privacy rights; or
- resell, transfer, relabel, or divert products in violation of law or these Terms.
10. Intellectual property
The website's original text, graphics, logos, design elements, and compilation are owned by or licensed to VIAL TEKNOLOGIES LLC and are protected by applicable law. You may use the website only for lawful evaluation and purchasing. No license to Peptiqo Labs branding or other intellectual property is granted except as expressly stated.
11. Third-party services
The website may rely on or link to third-party services, including hosting, commerce, payment, shipping, security, and performance providers. Third-party services are governed by their own terms and policies. To the extent permitted by law, we are not responsible for a third party's independent acts or services.
12. Disclaimers
To the fullest extent permitted by law, the website and its content are provided on an "as available" basis. We do not guarantee uninterrupted access, error-free content, product availability, delivery dates, or that catalog content will meet a particular research requirement. Any express product commitment must appear in the applicable product listing, posted testing record, or a written agreement signed by an authorized representative of VIAL TEKNOLOGIES LLC.
These disclaimers do not exclude a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, VIAL TEKNOLOGIES LLC and its owners, employees, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, an account, an order, or misuse of a product. This limitation does not apply where liability cannot lawfully be limited.
14. Suspension and termination
We may suspend or terminate access when reasonably necessary to protect the website, investigate suspected fraud or misuse, comply with law, or enforce these Terms. Provisions that by their nature should survive termination will survive.
15. Governing law and venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. A dispute not subject to a different legally required forum will be brought in a state or federal court with jurisdiction in Bernalillo County, New Mexico.
Nothing in this section waives a consumer, privacy, procedural, forum, or other right that applicable law does not allow the parties to waive.
16. Changes
We may update these Terms to reflect operational, product, or legal changes. Updated Terms will be posted with a new effective date. If required by law, we will provide additional notice. The terms in effect when an order is accepted govern that transaction unless law requires otherwise.
17. General provisions
If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision is not a waiver. These Terms and the policies incorporated into them form the agreement concerning use of the website and store, except for a separate written agreement signed by an authorized representative of VIAL TEKNOLOGIES LLC.
